1. About GENSETZ

GENSETZ (gensetz.com), operated by [Legal entity name], [Registered office address] ("GENSETZ", "we", "us"), is an online business-to-business marketplace that allows sellers to list used and refurbished diesel generators ("gensets") and allows buyers to browse listings and contact sellers. By creating an account or using the Platform, you agree to these Terms of Service.

2. Our role

GENSETZ is a listing and enquiry platform only. We are not a party to any sale, rental or other transaction between buyers and sellers. We do not own, inspect, store, test, transport, install or warrant any generator listed on the Platform. Price, condition, inspection, payment, delivery, installation, warranty and after-sales terms are agreed directly between buyer and seller.

3. Accounts

• You must provide accurate, current information and keep your login details confidential.
• Seller accounts are intended for businesses and individuals legally entitled to sell the generators they list.
• GST, PAN and other business details are captured as provided by the seller. GENSETZ does not automatically verify them.
• We may suspend or close accounts that breach these Terms or are used for fraud or misuse.

4. Listings and approval

• Each listing must describe a real generator that the seller owns or is authorised to sell.
• Listings must include accurate specifications (including kVA rating, make, model, year and running hours where known), at least the minimum number of genuine photos required by the Platform, and a clear photo of the nameplate.
• Optional videos, test reports and warranty documents must be genuine and relate to the listed unit.
• All listings are reviewed by the GENSETZ team before publication. We may approve, request changes to, reject or remove any listing at our discretion.
• Approval of a listing is not an endorsement, certification or verification of the generator, its condition, its emission compliance or the seller.
• Sellers must update or remove listings promptly once a unit is sold or no longer available.

5. Buyer responsibilities

• Buyers are responsible for their own due diligence, including physical inspection, load testing, checking documents and ownership, and confirming that the generator meets applicable regulations at the installation site.
• Buyers should not make payments for a generator without adequate verification and written agreement with the seller.

6. Plans, fees and payments

• New sellers may be offered a free introductory listing period. After this period, continued or additional listings may require a paid plan.
• Plan features, prices (in INR, exclusive or inclusive of GST as stated) and durations are shown on the Platform at the time of purchase.

7. Prohibited conduct

9. Disclaimers and limitation of liability

The Platform is provided on an "as is" and "as available" basis. To the extent permitted by law, GENSETZ is not liable for any loss arising from transactions between users, the condition or performance of any generator, the accuracy of listings or user-provided information, or any indirect or consequential loss.
